  The Labour Department (“LD”) has grave concern over the fire safety at construction sites.  In light of the recent changes in fire risks at construction sites that have caused serious injuries and fatalities of workers, LD have recently issued an advisory letter to major construction contractors to remind them of taking adequate safety measures to ensure workers’ safety at work.  A copy of the letter is attached below for your reference.

  主旨: 註冊安全主任的法定職責

  

  先生／女士： 註冊安全主任的法定職責   1.             勞工處謹此提醒所有註冊安全主任（安全主任），必須履行《工廠及工業經營(安全主任及安全督導員)規例》(第59Z章) (規例)所訂明的法定職責。   2.             安全主任在協助工業經營東主保障僱員的工作安全及健康方面，擔當重要角色。根據規例第15條，安全主任的職責包括但不限於: (i)     為在工業經營中受僱的人的安全及健康，而就應予採取的措施向東主提供意見，並在東主批准下實行該等措施； (ii)    檢查工業經營，或指示任何在其內受僱為安全督導員的人檢查該工業經營，以決定是否有任何機械、工業裝置、設備、器具或工序或在該工業經營中進行的任何類型工作，屬於可造成任何在該工業經營中受僱的人有受身體傷害危險的性質； (iii)   將檢查的結果向東主報告，並就該檢查結果而應予採取的任何措施(如有的話)作出建議； (iv)   協助監督任何在該工業經營中受僱為安全督導員的人；及 (v)    收取、討論及加簽每份由受僱為安全督導員的人向他呈交的報告。   3.             另外，根據規例第9條，勞工處處長如認為該安全主任沒有資格、沒有足夠能力及不是適合及適當人選註冊為安全主任，即可取消其註冊。   4.             《工廠及工業經營條例》(第59章)的一般責任條文亦規定，工業經營的每名受僱的人，於工作時均有責任為其本人及其他人(可能受到該受僱的人工作時的作為或不作為所影響者)的健康及安全，採取合理的謹慎措施。安全主任如沒有履行規例所訂明的法定職責，有可能被視為違犯一般責任條文，一經定罪，可處罰款港幣150,000元及監禁6個月。   5.             如想獲取最新的職業安全及健康資訊，請掃瞄以下二維碼或從https://www.labour.gov.hk/public/os/app/ 下載勞工處「職安健2.0」流動應用程式。   「職安健2.0」流動應用程式   6.             如有任何疑問，請致電3104 2506與本處職業安全主任聯絡。   勞工處處長 ( 李永強           代行 )

  Dear Sir/Madam,   Statutory Duties of Registered Safety Officers   1.             The Labour Department (“LD”) writes to remind all Registered Safety Officers (“RSOs”) of their fulfilments of statutory duties stipulated under the Factories and Industrial Undertakings (Safety Officers and Safety Supervisors) Regulations, Cap. 59Z (“SOSSR”).   2.             RSOs play important roles in assisting the proprietors of industrial undertakings to safeguard the safety and health of employees at work.  Pursuant to regulation 15 of SOSSR, the duties of RSO include, but not limit to: (i)     advising the proprietor as to measures to be taken in the interest of the safety and health of persons employed in the industrial undertaking and, with the approval of the proprietor, implementing such measures; (ii)    inspecting the industrial undertaking, or directing any person employed as a safety supervisor therein to inspect the industrial undertaking for the purpose of determining whether or not there is any machinery, plant, equipment, appliance or process or any description of work carried on in the industrial undertaking which is of such a nature as to be liable to cause risk of bodily injury to any person employed in an industrial undertaking; (iii)   reporting the findings of any inspection carried out to the proprietor and recommending what measures, if any, ought to be taken as a result of that inspection; (iv)   assisting in the supervision of any person employed as a safety supervisor in the industrial undertaking; and (v)    receiving, discussing and countersigning every report submitted to him by a person employed as a safety supervisor.   3.             Besides, under regulation 9 of SOSSR, the Commissioner for Labour may cancel the registration of a RSO if the Commissioner is of the opinion that the RSO is not qualified, competent, fit and proper to be registered as a safety officer.   4.             The general duties provisions of the Factories and Industrial Undertakings Ordinance (Cap. 59) also stipulate that it shall be the duty of every person employed at an industrial undertaking while at work to take reasonable care for the health and safety of the person and of other persons who may be affected by the person’s acts or omissions at work.  A RSO if failed to perform his/ her statutory duties under SOSSR, he/ she would be deemed as failure to comply with the general duties provisions and is liable on conviction to a fine of HK$150,000 and to imprisonment for 6 months.   5.             If you want to obtain the latest occupational safety and health information, you may scan below QR code or via https://www.labour.gov.hk/public/os/app/ to download the “OSH 2.0” Mobile Application of LD.     “OSH 2.0” Mobile Application   6.             For enquiries, please contact the Occupational Safety Officer of LD at : 3104 2506.   Yours faithfully,   ( LEE Wing-keung ) for Commissioner for Labour
