    受疫情影響,香港建造學院(學院) 20221月起,暫停包括建造工友(指定行業)安全訓練(銀卡)、密閉空間合資格人士及核准工人之從事渠務署工程安全訓練課程在內所有面授課程。

     

    學院將會在恢復面授課堂後,加開銀卡課程班次,務求盡快讓已報讀人士入讀,惟相關課程目前輪候人數眾多,因此學院作出特別安排,詳情在以上附件。

    彈性處理未能及時修讀強制性安全訓練重新甄審資格課程(即重温課程)的僱員 Flexible arrangement for employees who are unable to complete Mandatory Safety Training Revalidation Courses in Time

     

    先生/女士: 

                    隨著第五波2019冠狀病毒病疫情爆發,對課程營辦機構所提供的強制性安全訓練課程的整體供應已產生影響。就未能及時修讀強制性安全訓練重新甄審資格課程的僱員,勞工處現作出以下彈性處理安排。

    2.        根據《工廠及工業經營條例》(第59章)及其附屬規例,個別指定行業或進行指定工序的僱員,必須完成修讀相關的強制性安全訓練課程並持有有效的證明書,並須要按時修讀相關的重新甄審資格課程(即重温課程),方能從事這些指定行業或進行指定工序。另外,相關工作地點的負責人亦須確保其僱員持有有效的訓練證明書。 

    3.        勞工處留意到部份課程營辦機構已暫停或縮減提供其強制性安全訓練課程,而部份持有已到期或即將到期的強制性安全訓練證明書的僱員,亦因響應政府呼籲減少參與社交活動暫不報讀相關課程,或令個別有需要續證的僱員未能在指定期限1內報讀重温課程。有見及此,勞工處為持有證明書於202211日至430日(包括首尾兩天)到期的僱員,作出以下特殊安排: 

    (i)        容許他們若未及報讀重温課程可繼續進行指定工作,有關工作的期限見下表丙欄;以及 

    (ii)        延長這些僱員報讀相關重温課程的期限,有關報讀的期限見下表丁欄

    4.        僱員若持有於乙欄所指期間到期的證明書,應盡快聯絡課程營辦機構,並及早報讀相關重温課程。 

    5.        勞工處必須強調,上述乃在疫情期間的非常特殊安排,並不應視此為先例。勞工處會密切留意情況的發展,適時檢視上述的特殊措施。 

    6.        若僱主透過上述特殊安排聘用未及報讀重温課程的僱員,必須繼續遵守職業安全及健康(職安健)法例的其他條文,確保這些僱員在安全及健康的環境工作,避免意外發生,並安排這些僱員省覽以下與其工作相關的職安警示動畫及相關資訊:

    7.        而僱員亦要嚴格遵守僱主的施工方案,並在工作期間落實執行相關的措施,負起保障自己及其他工友職安健的責任。 

    8.        上述安排並不適用於持有在本年51日或之後到期的證明書的僱員,他們必須按照現行要求持有有效的證明書,方能從事指定的工作。

    Dear Sir/Madam, 

                    Following the outbreak of the fifth wave of the COVID-19 epidemic, the overall supply of Mandatory Safety Training (“MST”) courses provided by training course providers (“TCPs”) is affected.  In respect of the employees who are unable to complete MST revalidation courses (“revalidation courses”) in time, the Labour Department (“LD”) now makes the following flexible arrangements.

    2.                Pursuant to the Factories and Industrial Undertakings Ordinance (Cap. 59) and its subsidiary regulations, employees working in specified industries or involving in specified activities shall complete MST courses with relevant certificates attained, and take the relevant revalidation courses in time before they are allowed to work in such specified industries or perform such specified activities.  In addition, the persons responsible for the relevant workplaces shall ensure that their employees possess valid certificates. 

    3.                The LD notices that some TCPs have suspended or reduced the provision of their MST courses, and some employees whose MST certificates have expired or are about to expire have deferred their enrollment in relevant courses in response to the Government’s appeal for minimising social activities.  As a result, employees who are obliged to revalidate their certificates may not be able to enrol in revalidation courses before the expiry of admission period1.  To cope with the situation, the LD makes the special arrangements for the employees whose certificates with expiry dates falling within January 1 to April 30, 2022 (both dates inclusive) as follows:-

    (i)        allowing those who are not able to enrol in revalidation courses to continue to be engaged in the specified work (details in column C of the table below); and 

    (ii)        extending the admission deadlines for the revalidation courses concerned for these employees (details incolumn D of the table below).

    [1 According to the prevailing mechanism, employees are allowed to enrol in the relevant revalidation courses within 3 to 6 months (depending on the types of MST courses) after the expiry of their MST certificates.]

    4.                Employees holding an MST certificate with expiry date falling within the period specified in column B should approach the TCPs and apply for the relevant revalidation courses as soon as possible. 

    5.                The LD emphasises that the above arrangements are exceptional in light of the epidemic, and should not be seen as a precedent.  We will closely monitor development of the situation and review the above special measures in due course. 

    6.                When employing employees who are not able to enrol in the relevant revalidation courses in time pursuant to the above special arrangements, employers shall continue to comply with other provisions under the occupational safety and health (“OSH”) laws, so as to ensure the work safety and health of these employees and to prevent occurrence of accidents.  Such employees should also be arranged to peruse the “Work Safety Alerts” animation videos and related information relevant to their work:

    7.                Employees are also reminded to strictly follow the method statements of employers and implement the relevant working procedures while at work to safeguard the OSH of themselves as well as other employees. 

    8.                The above arrangements are not applicable to employees holding a certificate that expires on or after May 1, this year.  Pursuant to the current requirement, they shall hold a valid certificate when engaged in the specified work.
